Considering the current provision of related law in China and referenc ing the related theory of foreign country, the article analyzes the nature of the rights transmitting by the cash deposit contract and concludes that the right should be ownership.

从我国现行法律法规的有关规定出发，结合外国相关理论分析现金存款合同转移权利的性质，认为将该权利认定为所有权更符合法学理论也更符合金融制度的实际。
